Refusing To Blow Ends With Charge

(BLUEWATER, ON) - A 38-year-old from Zurich is facing the criminal charge of Refusal to Provide a Breath Sample after he was stopped by Huron County Ontario Provincial Police (OPP) this past weekend.

On Sunday, November 3, 2019 at approximately 6:07 p.m. Huron OPP officers received information pertaining to a driver that may be operating a vehicle while under the influence of alcohol.

OPP officers responded to Zurich and the suspect vehicle was observed approximately 45 minutes later travelling westbound on Main Street. A traffic stop was initiated and the vehicle driver pulled over.

Upon speaking with the driver the investigating officer noted the driver was displaying some signs that he had consumed alcohol. The driver complied with the roadside demand for the approved screening device and provided a roadside sample. The sample resulted in a fail so the driver was arrested and was transported to the Huron OPP Detachment for breath tests.

A subsequent demand for breath samples by the Intoxilizer Technician was made however the driver refused to provide any samples into the Intoxilizer.

Consequently, 38-year-old Damion WILLERT from Zurich has been charged with Failure or Refusal to Comply with Demand. He was later released from custody with a court appearance scheduled for December 2, 2019 at the Ontario Court of Justice - Goderich.

His vehicle was towed and his driver's licence has been suspended for an automatic 90 days.
